Litigation is a poor way to resolve disputes. It's cumbersome, distracting, expensive, stressful, and full of knowable and unknowable risks. Mediations, especially using Zoom for videoconferences with screen sharing and breakout rooms, is safe, secure, effective, and very efficient. Arbitrations, even document and witness intensive arbitrations, can also be handled in an effective, fair, efficient, and satisfying manner.
Mediation allows the parties to confront the risks and opportunities presented by potential, threatened, or pending litigation in a secure environment where the discussions are confidential; the outcome is dictated by the parties (not by a judge or arbitrator); and the options for resolution can include choices no court can order.
The mediation process allows the parties to break down the critical elements of their disputes and assess their strengths, weaknesses, exposures, and opportunities. For these matters, Blackman ADR Services provides a cost-effective way to get to the essence of a case, explore underlying issues, evaluate a range of outcomes in light of the facts and law, and then find a better resolution than is likely to be the case after an onerously expensive trial in which justice is uncertain.
Where factfinding on disputed issues is essential to a resolution of a dispute, arbitration proceedings focused on particular issues or the entire dispute presents a more effcient, effective, and potentially confidential method to resolve the dispute without the risk and excessive cost of an official judical proceeding.
Lee Blackman, Blackman ADR's Principal, is an experienced litigator, mediator, and arbitrator with a broad and sophisticated background in a wide range of legal areas, including simple and complicated business, regulatory, employment, negligence, civil rights, and environmental disputes. In mediations, his strength are case analysis, thoughtfulness, creativity, persistence, and respectful risk assessment. He searches for ways to protect and advance core interests through effective settlement discussions.
As an arbitrator, Mr. Blackman brings significant exprience to the process, both as trial counsel and as a temporary judge. He understands the trial process and how to adapt it efficiently to a proceeding driven by party choice, but with a focus on effciiency and fairness.
He is Zoom experienced and proficvient. He and trains mediators and arbitrators to use Zoom effectively and is fully familiar with all of Zooms security, safety, and and simplicity features.
What We Do
We are not a big shop. For a fee that is highly competative -- because we dispense with case coordinators and extensive facilities -- we first become familiar with the nature of your dispute and the parties' interests, mainly through pre-mediation calls or a prehearing conference, short mediation statements and streamlines case preparation, and targeted research into any unusual legal issues. We then convene a session or sessions -- using Zoom while the Covid-19 pandemic requires social distancing. Mediations assess critical elements of the disputes and focus on guiding the parties toward alternative resolutions that protect the parties' essential interests while avoiding costs, distractions, and litigation risks.
